ちょっと刺激的なタイトルにした。国際司法裁判所が、すなわち岩澤判事、弁護に入った京大の濱本教授を含む世界の国際法専門家たちが、そして中露を含む116カ国が、チャゴス諸島3,000人の「自決権」を否定したのである。

私の2つ目の博論は海洋法を基盤に太平洋島嶼国の自決権を中心にまとめる予定である。チャゴス諸島の件は、最初海洋保護区の件で知った。その後2019年のICJの判決で自決権が判決の重要テーマになった事を。

歴史的背景がまったく違うチャゴス諸島の件を博論に入れるつもりはなかったのだが、モーリシャスとチャゴス諸島の国家形成、すなわち自決権のあり方として軽く触れたくなってきた。

たった2、3日ウェブ情報で勉強しただけで、モーリシャス政府とチャゴス諸島の人々が一体でないどころか、敵対していることがわかる。そしてモーリシャス政府が欲しいのはチャゴス諸島の人々の幸せではなくて、米軍のお金なのだ。現在英領のチャゴス諸島がモーリシャスの領土、主権下に入れば米国と直接土地使用の交渉ができる。さらに怖いのは中共の影響である。ディエゴガルシアにある米軍は、インド洋で唯一の軍事基地あり、中東の安全保障を担う。すなわち日本の安全保障に直結する。

このビデオでチャゴス諸島の代表がモーリシャス政府に統治される事は最悪のシナリオです、と語っているが、インド太平洋構想の主要メンバー、日米豪英仏などにとっても最悪のシナリオなのだ。

私の疑問は、こんな明白な実態を岩澤判事、弁護に入った京大の濱本教授は知らなかったのか?もしくは知っていて、それでもモーリシャス政府を支援した理由は何か?である。

 

I made the title a little provocative. The International Court of Justice, i.e., Judge Iwasawa, international law experts from all over the world, including Professor Hamamoto of Kyoto University who defended the case, and 116 countries including China and Russia defended the case, i.e. - denied the " self-determination" of 3,000 people in the Chagos Islands.

My second PhD thesis will be based on the law of the sea and will focus on self-determination for Pacific island nations. I first learned about the Chagos Islands through the Marine Protected Area case. Then, I learned that the right to self-determination became an important theme of the ICJ's decision in 2019.

I didn't intend to include the case of the Chagos Islands, which has a completely different historical background, in my thesis, but I wanted to touch on it lightly as the formation of a state, or the way of self-determination, between Mauritius and the Chagos Islands.

After only a couple of days of studying on the web, I can see that the government of Mauritius and the people of the Chagos Islands are not united, but rather hostile to each other. And what the Mauritian government wants is not the happiness of the people of the Chagos Islands, but the money of the US military. If the Chagos Islands, which are now British territory, come under Mauritius' r-territory and sovereignty, it can directly negotiate with the US for land use. What is even more scary is the influence of the Chinese Communist Party. The U.S. military base in Diego Garcia is the only military base in the Indian Ocean and is responsible for the security of the Middle East. In other words, it is directly related to Japan's security.

In this video, a representative of the Chagos Islands says that being governed by the Mauritius government is the worst-case scenario, but it is also the worst-case scenario for the key members of the Indo-Pacific Initiative, including Japan, the US, Australia, Britain, and France.

My question is: Didn't Judge Iwasawa and Professor Hamamoto of Kyoto University, who came to the defense, know about this obvious reality? Or, if they did, why did they still support the Mauritian government? That's the question.
